Before downloading the Model, you must accept the agreement shown below.
Acceptance and License Agreement
By downloading or using the Model, you (if an individual) or your employer (if you are an employee; in either case, the "Licensee") accept the following terms.
Analog Devices, Inc. hereby grants Licensee a nonexclusive, nontransferable license to use the Model for purposes of assessing Analog Devices products as long as Licensee abides by the terms of this agreement.
Disclaimers; Reservation of Rights:
Licensee understands that the mathematical behavioral characteristics and formulas for the Model have not been fully characterized for production specification or exact compliance to actual part operation. The Model is useful for general simulations but not intended for safety critical, manufacturing yield, or similar safety or financial decision making simulations. Analog Devices, Inc. reserves the right to make changes to its products and/or the Model without notice.
The Model is provided for Licensee’s convenience only, is provided AS IS, and may not be supported by Analog Devices, Inc. ANALOG DEVICES, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF NONINFRINGMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
The Model is protected under the copyright laws of the United States and other countries, and Analog Devices reserves all rights not expressly granted in this agreement. Without limiting the foregoing, Licensee may not sell, loan, rent, lease, license, display in public, disclose or distribute the Model, in whole, in part, or in modified form, to anyone outside Licensee. Licensee may modify the Model to suit Licensee’s specific application, and may make copies of the Model for use by Licensee only. No other rights, express or implied, are granted to Licensee under this agreement.
No Indemnification; Limitation of Liability:
Analog Devices, Inc. does not indemnify, nor does it hold Licensee harmless, against any liabilities, losses, damages of any type (however characterized, e.g. direct, indirect, collateral, incidental, special, consequential), and expenses (including attorney’s fees) relating to any claims whatsoever, including without limitation, claims for personal injuries, death or property damage. IN NO EVENT SHALL THE ACCRUED TOTAL LIABILITY OF ANALOG DEVICES, INC. FROM ANY LAWSUIT, CLAIM, WARRANTY OR INDEMNITY EXCEED $100.00 (One Hundred Dollars). The Parties agree that the foregoing terms constitute the entire agreement, and that this agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and the United States, without regard to choice of law provisions.
